In the third segment of a four-part series on Weaver: Beyond the Numbers, T.J. Liles-Tims and Liza Bowersox look at the significance of prenuptial agreements in safeguarding both personal and business assets. This discussion also features the role of valuation in asset protection, implications of marital dissolution on business ownership and common misconceptions surrounding prenuptial agreements.
Key Points:
Valuation can play a critical role in protecting assets within marriages and business partnerships. Establishing a value at the start of a relationship, either marital or business, helps to ensure that individuals are prepared should they later need to divide assets.
“Every partnership — business partnership, marital partnership — has a default prenuptial agreement. The law dictates what happens in the event of the dissolution of the marriage, the dissolution of the business. The question is, is that the agreement you would choose? You have a choice — you craft your own agreement or you deal with what the law will force on you,” said Liza.
