Sean: We’ve case that deals with the self-employment of limited partners. This was a tax-favorable case. It was in the Fifth Circuit.

Sean: There are several other cases that actually the taxpayers lost on the definition of a limited partner. And this was the one winning case, so now taxpayers in the First and Second circuits may try to rely on Sirius Solutions case to support similar arguments.

Sean: Well, the Justice Department, rather than appealing the case in the Fifth Circuit, they have actually gone back to the Fifth Circuit, because it was a split decision, and asked the Fifth Circuit to reconsider the case.

Sean: They have said that, “You’re going to strip away all this money from Social Security,” and argued it’s a bad ruling and inconsistent with the law, emphasizing the impact on the government with all these dollars.

Sean: We’ll see how that plays out, but rather than appealing it, they’ve asked the Fifth Circuit to reconsider the entire case. So we’ll see how that plays out.
