The Client
The client is a U.S.-based antimicrobial technology company engaged in the development, production and marketing of specialized products designed to inhibit bacterial growth using its patented technology. The company’s operations spans national markets. Maintaining product quality and safety is critical to its reputation, customer trust and ongoing commercial success.
The Challenge
The client (plaintiff) was involved in a legal dispute with its contracted manufacturer (defendant), alleging defects in both the products and packaging. Weaver’s scope of work focused on analyzing the plaintiff’s financial records to quantify the expenses incurred in developing, advertising and selling the product at issue, as well as an analysis of the resulting profitability.
It was critical to accurately quantify these damages, as the outcome would directly influence our client’s ability to recover financial losses and uphold the value of its products and brand in national markets.
The Process
Weaver’s forensics, litigation and valuation services team worked closely with the client to provide practical and defensible methodologies for quantifying the economic damages incurred. To support their analysis, our approach included a detailed review of multiple financial sources:
- Historical business records
- Financial statements
- Various invoice and other supporting documentation for both parties
- Business plans and market studies
Our team also leveraged data from reputable private capital market reports and industry surveys to quantify the expected return on the plaintiff’s research and development investment for the product at issue. This approach allowed the team to establish a data-driven foundation for the economic damages calculation.
Throughout the process, Weaver ensured methodologies were clearly documented, reproducible and defensible. Our team collaborated with the client to validate assumptions and gain a more thorough understanding of the facts and circumstances, producing an analysis that could withstand rigorous examination in deposition and trial settings.
The Deliverables
Weaver compiled its findings into a comprehensive expert report that detailed and supported the calculation of economic damages. Blake Danielak represented Weaver and submitted the expert report from which he was deposed and ultimately provided expert testimony during the jury trial to explain and support his analysis.
In the end, the jury returned a verdict for the full amount the plaintiff sought to recover totaling nearly $3.5 million in damages. The client was highly satisfied with the outcome and the professionalism, diligence and experience demonstrated by the Weaver team.
