Effective as of July 1, 2025, House Bill 11 (WY HB0011) will bring significant changes to the state of Wyoming’s sales and use tax manufacturing exemption, impacting various industries and expanding tax savings opportunities.

Use Tax Update

Wyoming previously restricted the use tax manufacturing exemption to be available only to companies classified under the North American Industry Classification System (NAICS) code manufacturing sector 31 through 33.

One of the key provisions of the bill is the removal of the use tax classification requirements that were previously tied to NAICS codes 31 through 33. This change aligns the use tax exemption with the sales tax exemption language to broaden the eligibility criteria for the manufacturing exemption, opening up opportunities for a wider range of industries to benefit from use tax savings.

Additionally, the provision in the use tax manufacturing exemption that excludes noncapitalized machinery will be repealed.

The repeal of the use tax exemption specific NAICS codes and noncapitalized machinery exclusion allows for a more inclusive approach to defining manufacturing activities and tax savings opportunities in Wyoming.

Sunset Extension

WY HB0011 extends the sunset date for the existing sales and use tax manufacturing exemption by 15 years, pushing the expiration date to December 31, 2042.
