The Client
The client (plaintiff) was a pest control company owner involved in a legal dispute with his co-owner (defendant) alleging that company funds were misappropriated for personal use.
The Challenge
Our scope of work primarily involved analyzing 13 years of individual credit card transactions from multiple different credit card accounts. Moreover, the defendant restricted our client’s access to the company’s financial records and relevant credit card statements.
The Process
Weaver’s forensic and litigation services team provided the client with practical and defensible methodologies to quantify the misappropriated funds. To support their analysis, Weaver reviewed the following sources:
- Credit card statements
- Bank statements
- Historical IRS audit findings
- QuickBooks records
- Payroll reports
Due to limited access to the company’s and defendant’s credit card statements, Weaver leveraged data from a recent IRS audit to extrapolate personal expenses that were improperly deducted on the company’s tax return.
The Deliverables
As a result of our work, Weaver delivered the following key components that supported a successful legal outcome:
- Report: Weaver’s forensic and litigation services team compiled its findings into a comprehensive expert report that detailed and supported the calculation of over $1 million in funds used for the defendant’s personal benefit.
- Testimony: T.J. Liles-Tims, representing Weaver, submitted the expert report from which he was deposed and, ultimately, provided expert testimony during the jury trial to explain and support his analysis.
- Outcome: The jury ultimately returned a verdict in favor of the plaintiff, awarding $1,021,799 in compensatory damages and $1,064,866 in punitive damages.
